Terms of Service

These Terms of Service ("Terms") govern your access to and use of msrp.fun and its associated mobile application (the "Service"), operated by Pachi and friends LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

Use of the Service

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Scrape, crawl, or systematically extract data from the Service without our written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to transmit any unsolicited or unauthorized advertising or promotional material.

Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@pachi.fit if you suspect unauthorized access to your account.

Subscriptions and Payments

Some features of the Service are available under a paid subscription. Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees incurred. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are issued at our discretion in accordance with applicable law.

Alerts and Accuracy

The Service monitors third-party marketplaces and sends alerts based on automated processes, including machine learning classifiers. We do not guarantee that all relevant listings will be detected, that alerts will be delivered in real time, or that any listing flagged by the Service will be accurate, available, or priced as described at the time you view it. Purchasing decisions are solely your responsibility.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Pachi and friends LLC. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. Card names, images, and related intellectual property belong to their respective owners and are referenced for informational purposes only.

Third-Party Services

The Service may contain links to or integrations with third-party websites and services, including eBay, TCGPlayer, Shopify, CardTrader, and TikTok Shop. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. Your interactions with those services are governed by their own terms.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PACHI AND FRIENDS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at hello@pachi.fit. Termination does not entitle you to a refund except where required by applicable law.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any change constitutes acceptance of the new Terms.
